Hotel Mixed-Use Development Projects

I. SCOPE
What is a mixed-use project? Although the phrase may have different meanings in different industries, for purposes of this article it is assumed that a mixed-use development is comprised of at least one traditional hotel component coupled with one or many of for-sale condominiums, single family lots, villas, fractional ownership products, spa, golf, ski and/or other amenities and/or a retail component.
Hotel projects by themselves are complex. The complexity results from the fact that a hotel is not just a building, but is more like a “business in a box.” The usual real estate and construction issues arising from building the “box” combine with the specialized issues arising from the needs of the hotel business that must be run at a profit inside the box.
Mixed use projects add even more layers of complexity. This article addresses both general and unique issues, structures, and considerations involved in these projects.
