Our construction and design attorneys work with clients to draft contracts, conduct risk analysis and loss prevention, and provide alternative dispute resolution and litigation. Two of our attorneys are licensed civil engineers who bring a broader perspective to the legal aspects of the construction industry. Services include:
- Selecting the appropriate project delivery system (design-build, design-bid-build, GC/CM, or some variation), taking into consideration cost, quality, project delivery time, and risk allocation.
- Selecting the appropriate form of contract, whether fixed price, cost reimbursable, guaranteed maximum price, or some variation.
- Evaluating project insurance requirements to ensure sufficient coverage for general and professional liability risks as well as risk of property loss during construction.
- Selecting the appropriate form of performance and payment bonds, or other form of guarantee of project performance. Negotiation and drafting of terms of contract warranties and guarantees to ensure that performance and quality objectives are met.
- Resolving disputes involving architect and engineer liability for defective design and construction management; contractor delay and disruption claims; construction safety and personal injury claims; insurance coverage for property damage, personal injury, and construction defect claims; WISHA and OSHA Surety claims; mechanics’ liens and Miller Act claims.
